By accessing or using the website at palmdesertdeckandfence.com (the "Site") or by engaging Palm Desert Deck & Fence for services, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, do not use the Site or engage our services.
These terms apply to all visitors, customers, and anyone else who accesses the Site or requests services from Palm Desert Deck & Fence.
Palm Desert Deck & Fence provides residential and commercial deck building, fence installation, outdoor structure construction, and related services in Palm Desert, CA and surrounding areas of the Coachella Valley. Services are described on our Site for informational purposes. The scope of any specific project is defined by a written proposal or contract signed by both parties.
We reserve the right to refuse service to any person or entity at our discretion.
Written estimates provided by Palm Desert Deck & Fence are valid for 30 days from the date of issue unless otherwise stated. An estimate is not a binding contract. A project does not proceed until both parties have signed a written agreement and the required deposit has been received.
All prices are in US dollars. Costs may change if the scope of work changes after the estimate is issued, if unforeseen site conditions are discovered during the project, or if material prices change materially between the estimate date and the project start date. We will notify you of any price changes in writing before proceeding with additional work.
Project start dates are estimates based on permit timelines, HOA approvals, material availability, and crew scheduling. We make reasonable efforts to meet agreed-upon schedules, but we are not liable for delays caused by weather, permit processing times, HOA review periods, material shortages, or other circumstances outside our control.
If you wish to cancel a signed contract before work begins, you must notify us in writing. Cancellation fees may apply as outlined in your specific project agreement. Costs already incurred for permits, materials ordered, or other project-specific expenses are non-refundable.
Palm Desert Deck & Fence reserves the right to suspend or terminate work if payment is not received as agreed, if unsafe conditions exist at the work site, or if there is a material breach of the project agreement.
Payment terms for each project are specified in the written project agreement. In general, projects require a deposit before work begins, with the remaining balance due upon substantial completion unless otherwise agreed in writing.
Payments not received by the due date stated in the project agreement may incur a late fee. Palm Desert Deck & Fence reserves the right to file a mechanics lien on the property in accordance with California law if payment is not made as agreed.
We accept payment methods as specified in your project agreement. Personal checks are accepted at our discretion.
You are responsible for providing accurate information about the property and any restrictions that may apply, including HOA rules, easements, underground utilities, and property lines. You agree to call 811 or arrange for utility locating before excavation begins, or to authorize us to do so on your behalf.
You are responsible for obtaining any required HOA approvals before the project start date. We can assist with preparing documentation, but final approval responsibility rests with you as the property owner.
You agree to provide reasonable access to the work site during normal business hours. Delays caused by restricted access may affect the project schedule.
Palm Desert Deck & Fence warrants that work will be performed in a workmanlike manner consistent with industry standards. Any warranty terms specific to your project will be stated in your written project agreement.
Manufacturer warranties on materials - including composite decking, hardware, and structural components - are provided directly by the manufacturer and are subject to their terms. We will assist you in submitting a manufacturer warranty claim if needed.
Warranties do not cover damage caused by misuse, modifications made by others, extreme weather events, normal wear and tear, or lack of proper maintenance as outlined in the care instructions provided at project completion.
THE SITE AND ALL INFORMATION ON IT ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. PALM DESERT DECK & FENCE MAKES NO WARRANTIES REGARDING THE ACCURACY, COMPLETENESS, OR SUITABILITY OF SITE CONTENT FOR ANY PARTICULAR PURPOSE.
To the maximum extent permitted by applicable law, Palm Desert Deck & Fence shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to our services or the use of our Site - including loss of use, loss of revenue, or loss of data - even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising from a specific project shall not exceed the total amount paid by you to us for that project.
Nothing in these terms limits liability for personal injury caused by our negligence, or for any other liability that cannot be excluded or limited under applicable law.
All content on the Site - including text, images, logos, and graphics - is the property of Palm Desert Deck & Fence or its content suppliers and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from Site content without our prior written permission.
If a dispute arises between you and Palm Desert Deck & Fence, we encourage you to contact us first at sales@palmdesertdeckandfence.com or (442) 334-1765 to try to resolve it informally.
If informal resolution is not successful, disputes shall be resolved through binding arbitration in Palm Desert, California, in accordance with the rules of a mutually agreed upon arbitration organization. You agree to waive the right to a jury trial and to participation in a class action lawsuit. This arbitration clause does not prevent either party from seeking emergency injunctive relief in a court of competent jurisdiction where necessary.
These Terms and Conditions are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any legal proceedings not subject to the arbitration clause above shall be brought in the state or federal courts located in California.
Palm Desert Deck & Fence reserves the right to update or modify these Terms and Conditions at any time. When changes are made, the effective date at the top of this page will be updated. Continued use of the Site or engagement of our services after an update constitutes your acceptance of the revised terms. We encourage you to review this page periodically.
